What the right concerns
England’s NHS Choice Framework generally permits choice for qualifying first outpatient referrals to clinically appropriate providers and teams holding the relevant NHS contract. Exceptions apply, including urgent care and some onward referrals. The framework is specific to England.
Ask your referrer whether the proposed referral falls within that right and which providers can deliver the required service. A provider may offer several programmes, so name the service rather than asking only whether the company “takes NHS patients”.
What a choice does not create
Provider choice does not establish a right to a particular prescription, remove clinical criteria or turn an uncommissioned service into funded care. A weight-management assessment may lead to support or treatment different from the option a patient initially had in mind.
A useful discussion separates your preference from the clinical purpose. For example: you may need a remote service because travel is difficult, or a programme with a particular accessibility adjustment. Explain that need and ask which appropriate services can meet it.
Before the referral is sent
- Identify the clinical service being requested.
- Ask whether provider choice applies to this referral.
- Check that the intended provider holds the relevant NHS contract.
- Confirm the form, referral channel and necessary records.
- Keep the destination and confirmation details.
If a provider’s website describes NHS access, read the pathway details rather than assuming every programme on that website uses the same arrangements.
If the route is unclear
Raise an unoffered or unclear choice with the referrer first. The framework also describes contacting the ICB if the issue remains unresolved. Explain the particular referral and ask for the applicable rule or contract information.
Keep your enquiry focused: what service was requested, which provider you preferred, and the reason given for a different route. This gives the service something concrete to answer. A comparison website cannot overturn a clinical decision or book an NHS treatment on your behalf.

Does Right to Choose let me select Mounjaro or Wegovy?
Provider choice and treatment choice are different questions. A qualifying referral may allow a choice of appropriate service, but assessment, prescribing and funding rules still apply. Explain your needs to the referrer and ask what the programme can consider. It cannot promise a particular prescription before an individual assessment.
Can I use an England choice rule if I live elsewhere in the UK?
This guide describes England’s NHS Choice Framework. Do not transfer it automatically to Scotland, Wales or Northern Ireland. Establish which NHS system is responsible for your referral and use its guidance. Cross-border circumstances deserve a specific answer from the referring service rather than a general website assumption.
What should I do if I was not offered a choice?
Ask the referrer whether the proposed referral falls within the relevant choice right and which services meet the requirements. If the issue remains unclear, the framework describes approaching the ICB. Keep the enquiry focused on the referral and applicable rule, rather than assuming every difference of clinical opinion is a choice-right breach.
